NOURISH RETREATS CANCELLATION POLICY
The cancellation policy below will apply for all cancellation scenarios, with no exceptions. This cancellation policy has been designed to be as compassionate as possible in the case that plans change, whilst also understanding our commitment to and cancellation policies with our vendors.
CANCELLATION BY PARTICIPANT
All cancellations must be submitted in writing by email to victoria@nourishbyvictoria.com.
If you would like to switch from one retreat date to another retreat date, this is considered a cancellation of the original retreat and will follow the cancellation rules below.
There will be no refunds under any circumstances.
For USA retreats, for cancellations made more than 90 days prior to the retreat start date, any payments made may either be transferred to a friend or family member, or to another retreat to India that is currently open for registration on the Nourish By Victoria website, within 7 days of your cancellation email.
For non-USA retreats, for cancellations made more than 90 days prior to the retreat start date, any payments made may be transferred to a friend or family member, if we are able to fill your spot.
For cancellations made 90 days or less prior to the retreat start date, any payments made may be transferred to a friend or family member, otherwise all payments will be forfeited and you should contact your travel insurance company for reimbursements. Nourish By Victoria Retreats cannot refund any payments for any reason (COVID, injury, illness, death). We highly recommend purchasing travel insurance.
For transfers to friends or family members, their information must be updated in the booking system and their contact information must be emailed to us at victoria@nourishbyvictoria.com at the time of the transfer.
CANCELLATION FEES
The cancellation fee is the amount equal to the non-refundable deposit for that retreat.
DELAYS AND OTHER UNFORSEEN CIRCUMSTANCES
There will be no refunds nor discounts for arriving late, leaving early, flight cancellations, travel delays or illness. For additional protection due to any unforseen circumstances, it is highly recommend that all participants purchase travel insurance at the time of booking the retreat.
CANCELLATION BY NOURISH BY VICTORIA
In the rare event of a cancellation by Nourish By Victoria Retreats due to low registrations, the participant will be given the option to transfer all payments to a future retreat or to receive a full refund. Nourish By Victoria cannot compensate participants for airfare, hotel and travel costs incurred.
In the rare event of a cancellation by Nourish By Victoria due to dangerous weather, political unrest, acts of god and other force majeure events, any refund provided will depend on Nourish By Victoria receiving a refund from the venue. Nourish By Victoria cannot compensate participants for airfare, hotel and travel costs incurred.
To cover these risks, it is strongly recommended that all participants purchases travel insurance.
If any payment is not received by participant prior to or on the due date for that payment, Nourish By Victoria has the right to cancel the participant's registration for that retreat. In this case, no refund will be provided.
Nourish By Victoria reserves the right to refuse or cancel any participant's registration for any reason. In this case, a full refund will be provided.
TRAVEL INSURANCE
Travel insurance can protect participants against participant cancellation, Nourish cancellation, lost or delayed baggage, medical expenses and the cost of repatriation should the participant become ill or injured. It is strongly recommended that all participants purchase travel insurance, including a 'cancel for any reason' option in order to protect them against the rare chance of cancellation. Travel insurance can be purchased at Insure My Trip.
RETREAT CHANGES
Nourish By Victoria reserves the right to make any changes deemed necessary by its team, leaders, teachers or business partners.

Participant Agreement and Release
I, ________________________________, agree that I am of sound mind and body and am in adequate physical and mental health to participate in activities and to preform tasks related to/or other wellness, body work, therapy, exercise, yoga, and healing arts and activities offered by the retreat organizers Victoria Kromhout and Al Ferguson, Nourish by Victoria, Reliable Vacation Ltd, Somatheerum/Ayursoma Group, and their Doctors, Therapists, and Representatives, hereto known as the Released Parties.
1. I represent and warrant that I am physically fit enough to participate, and I have no medical condition which would prevent my full participation in the activities described above. I recognize that the activities may cause or aggravate a physical injury or medical condition.
2. I understand that it is my responsibility to consult with a physician before my participation in the activities. If I have done so, I have taken the physician’s advice.
3. I understand that Nourish by Victoria reserves the right to refuse my participation in any activity on medical, fitness or any other health conditions.
4. I am aware that my participation in the activities (such as hiking walking, yoga postures, pranayama) could result in high blood pressure, fainting, heartbeat disorders, physical injury, heart attack or stroke and may aggravate pre-existing injuries.
5. I understand my physical limitations and I am sufficiently self-aware to stop or modify my participation in any activity before I become injured or aggravate a pre-existing injury. In consideration of being permitted to participate in the activities, I agree to assume full responsibility for any risks, injuries or damages, known or unknown, which I might incur as a result of participating in the activities.
7. I understand that Nourish by Victoria reserves the right to refuse my participation in any activity due to behaviors that interfere with the intent of the retreat experience.
8. By signing this agreement, the participant, agrees the retreat organizers Al Ferguson & Victoria Kromhout, Nourish by Victoria, Reliable Vacation Ltd, Ayursoma Group, and their Doctors, Therapists, and Representatives, will not be liable for injury, damage, loss, sickness, delay or irregularity that may be associated for any reason, including but not limited to:
a. yoga classes, health programs, any defect in a vehicle, delays or expenses arising from quarantine, strikes, thefts, civil disturbances, government restrictions or regulations, accidents by aircraft, boat, rowboat, train, bus, motor vehicle of any kind, auto rickshaw or bicycle rickshaw, acts of God, force of nature, terrorism, acts of war, or detention
b. or in any restaurant or place of visit or accommodation
c. failure of any means of transportation to arrive or depart as scheduled or changes to transit
d. missed airline connections
e. or additional expenses resulting from changes in exchange rates, tariffs, or itinerary. 9. I agree to indemnify and hold harmless each Released Party from any loss, cost, or liability incurred in defending any Claim made by me or anyone making a Claim on my behalf, even if the Claim is alleged to or did result from the negligence of any Released Party or anyone else. “Claim” includes but is not limited to any and all liabilities, claims, demands, expenses, fees, legal actions, rights of actions for damages, personal injury, mental suffering and distress, or death that I may suffer, my spouse, children or unborn child may suffer (including any legal fees or expenses) in connection with participation in any Activity.
10. I, my heirs or legal representatives forever release, waive, discharge and covenant not to sue any Released Party for any Claim caused by any negligence or other acts of a Released Party.
11. I hereby understand that Nourish by Victoria from time to time may photograph, video, or otherwise record classes or events occurring at the Journey to India Retreat and place such photographs and videos on its website or social media platform. I hereby consent to the use of my image that may appear in any such photograph or video.
12. This agreement shall be construed in accordance with, and governed by, the laws of the State of California and that all actions, suits, claims and proceedings related to this agreement shall be settled through arbitration. 13. In case any provision of this agreement shall be held invalid, illegal or unenforceable, it shall not affect any other provision of this agreement and this agreement shall be construed as if such provision had never been contained herein.
I acknowledge that I have carefully read this agreement and fully understand its contents. I voluntarily and knowingly agree to the terms and conditions stated herein.
I am aware that by signing this agreement, I am giving up substantial rights, including my right to sue and certain legal rights my heirs, next of kin, executors, administrators and assigns may have against any Released Party.
By entering my name below, I herby agree to the terms of this participant agreement.
